Coppola & Marlin Settles Catastrophic Brain Injury Case

The law firm of Coppola & Marlin recently settled a case on behalf of a young man who was severely injured in a head-on automobile collision

. The 30 year old husband and father of two young children worked at the University of Colorado Health Sciences Center as a research scientist. He was on his lunch break and was returning to work after eating at a fast food restaurant. As he was driving along a frontage road in Commerce City, another driver traveling in the opposite direction crossed the center line and hit his vehicle head-on. The other driver told the investigating police officer that he was on his way to a business meeting and became distracted while looking for an address in his day planner. When he looked back up, he realized that he had crossed the center line and into oncoming traffic, but he was unable to avoid the collision.

As a result of the collision, the client suffered catastrophic injuries, including multiple bone fractures and a severe traumatic brain injury. He was in a coma for approximately 3 months and was hospitalized for a total of 8 months. He incurred over $1,600,000.00 in medical and rehabilitation bills. Due to his brain injury, he was unable to return to his prior employment as a research assistant. An economist hired by Coppola & Marlin estimated the client’s future economic damages to have a net present value of more than $13,500,000.00.

Coppola & Marlin filed a lawsuit on behalf of the young man and his wife against the responsible driver and the driver’s employer. The defendant driver was a regional sales manager for a California computer component distributer. Under Colorado law, an employer can be held liable for the negligent acts of an employee while the employee is acting within the course and scope of his or her employment. The responsible driver was insured under an automobile liability policy and an umbrella liability policy. His employer was insured under a business auto policy and an umbrella liability policy. Coppola & Marlin settled the case against both the responsible driver and his employer for a confidential amount two months before trial. Coppola & Marlin also settled an underinsured motorist claim against the client’s own automobile insurance company.

Who talks to new client inquiry's at your firm? Do certain attorneys or intake personal do better than others? Have you noticed new client intakes go down when someone goes on vacation?

Phone skills (or the lack thereof) have a direct impact on your ability to sign up new clients. When is the last time you listened to your intake personnel or recorded yourself on an intake call so you can hear what the potential client is hearing? In this competitive market is more important than ever to do everything you can to turn those calls into clients.

1) Remember, it is about the client, or prospective client. Regardless of how busy you are, how good you may be, or how confident you are, it’s a competitive market. That prospective client has many options. Your firm is simply one of them. No firm has a “right” to the business.

True Story: I was in a client’s office when he took a call from a prospective client. He was very direct and asked a series of rapid-fire questions, cutting off the person on the other line several times. This was the first time that individual had contacted the firm. At the end of the short call, the attorney said something like, “well call me back sometime and we’ll try to set up an appointment.”

I asked my client if I could be honest with him for a minute. I reminded him that I have been in professional sales for over 20 years. Then I told him that was one of the worst calls I have ever heard. He never let the prospect even ask about hiring him. His response was that he is busy and had to get through the call quickly so he could get back to work. That may have been true, but the person on the other end of the phone may have turned out to be the next case (or series of cases). In all reality, with phone skills like those, he may soon not have to worry about those inconvenient calls, thus allowing him PLENTY of time to work on his last case. He forgot to build any type of relationship with the prospect. Moreover, that individual probably never called back because the attorney did not seem interested in LISTENING to the issues.

2) Place a digital recorder on your desk. Simply turn it on each time a prospective client call is received. Don’t worry about reviewing each call. Wait until the end of the day, or listen to it on the drive home.

3) Have someone you trust and respect listen to your calls. Did you have good phone skills (i.e. proper interest, good voice inflection, slow cadence, etc? Most importantly, did you differentiate yourself from your competitors, reference your website, ask if they would schedule a appointment)?

4) Remind yourself that while this is just one of a hundred cases you may handle, it is the most important case for that prospect. Did you reflect that importance in how you (or your intake person) handled that INDIVIDUAL?

5) We all know speed-of-response is important when handling a prospective client inquiry's. However, it might be better for you to take time out (mid-day or end of day) to return these important calls. Make sure you are in the proper mindset and can make this the most important part of the day. If that does not work, pass the call to a partner or associate. New clients are the lifeblood of any company. How you handle that initial call will impact whether you get the opportunity to have a new client or not.

If you are not converting those marketing dollars into clients you really need to take a step back and look at things like your intake system, follow up, client engagement, etc.
